ABUSE AGAINST LITTLE DAVID

  Court Action againstthe General Directorate for Child Protection (DGASPC) Covasna

Bucharest, the 14th of February 2013.Today the action against the General Directorate for Child Protection Covasna, which flagrantly violated the rights of little David, was submitted and filed with the Court in Covasna.

David is a 7 month old boy, born with Down syndrome and diagnosed with a complex cardiac malformation which puts his life in danger until the surgical intervention. Also, David presents all the particularities and vulnerabilities of a child with Down syndrome who beside the surgical intervention needs numerous forms of therapy and, evidently, a permanent attendant.

Under these circumstances, DGASPC Covasna, the institution empowered to decide a child’s degree of disability, sought to give an medium degree, which means a monthly allowance of 33.5 lei (7 Euros) and no right for an attendant. Moreover while interacting with the parents, DGASPC Covasna representatives have manifested superiority and indifference, stating that David’s rights are a form of goodwill from the institution they represent.

The European Centre for the Rights of Children with Disabilities (CEDCD) assists and monitors little David’s case during the civil litigation.“We believe that this kind of abuse and defiance not only has to stop, but they must be sanctioned.  We reiterate the fact that the authorities have the obligation to respect and protect the rights of children with disabilities both in the letter and also in the spirit of the UN Convention on the Rights of People with Disabilities”, declared Madalina Turza, president of CEDCD.
